Abu Dhabi Wills Registration Office at the Abu Dhabi Judicial Department (ADJD) has started video conference calls for the registration of Wills and Powers of Attorney in Abu Dhabi.

To start the process, you will need to have your Will(s) and Power(s) of Attorney (if required) prepared by Legal Inz as routine process. We will be assisting you with the registration of your Wills and Powers of Attorney with ADJD.

You do not need to be present in the UAE for the appointment or registration of your Will(s) and Power(s) of Attorney. There are no witnesses required for the registration process to be completed.

ADJD has indicated that it will contact you directly after we have taken approval on your drafts to book the appointment and guide you on the registration. At the video conference call, ADJD will discuss and notarize the approved Will(s) or Power(s) of Attorney and provide you with scanned copies of the notarized Will(s) or Power(s) of Attorney upon registration.

ADJD will then send two (2) certified true copies of the notarized Will(s) and Power(s) of Attorney to your address through Aramex.

How to Write a Will in UAE?

You are an expat living in the UAE or otherwise have assets in the UAE but you actually reside outside the UAE. You intend to make a UAE Will to pass on your assets to your intended beneficiaries instead of the legal heirs under the Sharia law and appoint guardians for your minor children. You want to give your family peace of mind. Wills for Abu Dhabi, Dubai, Sharjah, Fujairah, Ajman, Ras Al Khaimah and Umm Al Quwain lend you the peace of mind by allowing you to specify your beneficiaries.

Making a Will in the UAE is not difficult. Our online form will help you give us your instructions to prepare your UAE Will in three simple steps. You will need to keep the following considerations in mind while giving us your instructions:

1. Choose beneficiaries

Your beneficiaries are the individuals that will receive your property. Typically, wills in Abu Dhabi and in other Emirates such as Dubai, Sharjah, Fujairah, Ajman, Ras Al Khaimah and Umm Al Quwain may contain the following beneficiaries:

  • Your spouse
  • Your children
  • Your relatives (parents, siblings, grandparents)

It is possible to give your entire assets to your spouse and, in the absence of your spouse, to your children.

2. Appoint an executor

It is important to choose a personal representative (known as an ‘executor’) in your UAE Will. Your executor will be responsible for carrying out your wishes as stated in your UAE Will after your death. Your executor will handle your estate, pays off debts and distribute your estate to your beneficiaries. Typically, spouses are appointed as first choice executors in the UAE. However, you should also appoint at least one alternative executor in case your spouse does not survive you. If you have children over 21 years of age, you should appoint one or more of your children as an alternate executor(s).

3. Appoint Guardian for your children

If you have children below 21 years of age, your UAE Will should nominate the guardians for them. If your Will is registered with the DIFC Courts Wills Service, you should only nominate guardians for minor children who are habitually residing with you in the Emirate of Abu Dhabi.

If one parent passes away, the surviving parent would naturally be responsible for the minor children. A UAE Will should, however, appoint at least one or two alternate guardians to protect minor children in a situation where both parents pass away at the same time. You should note that if this is not done, the court will decide who will obtain custody of your minor children after your death.

Process of Registering Wills in Abu Dhabi

Here is a simplified process of writing and registering Wills with Abu Dhabi Wills Registry:

1. Place your order

Select Single or Mirror Wills and place your order by filling in our quick and easy online form. This form captures all the information required for us to prepare your Wills in Abu Dhabi. You can carry out a quick assessment of your situation to decide if you need Single or Mirror Wills in Abu Dhabi.

2. Review your drafts

You will receive the draft Will(s) in English by email within 3 working days of the date of your order. For orders that are marked as urgent at the end of our order form, the draft(s) are delivered in 1 working day. Once you have received the draft(s), you will have the chance to review and request any amendments at this stage.

3. Arabic translation is done

We will arrange the Arabic legal translation once the English draft(s) are approved by you. The translation takes 2 working days.

4. Your Wills are approved by the Wills Registry

We will submit your drafts to the Abu Dhabi Wills Registry for approval. The approval takes 1-3 working days. At this stage, you will be requested to transfer the will registration fee to us (i.e. AED 950 for Single Will and AED 1,900 for Mirror Wills). 5. Register your Wills

We will deliver the printed Will(s) to your home address and guide you on making an appointment with the Abu Dhabi Wills Registry. The primary objective of your UAE Will should be to nominate the beneficiaries who will receive your assets upon your death. These beneficiaries will typically be your family members and, in some cases, friends, charities and/or trusts. If you don’t have a UAE Will, the Sharia law will control who will receive your assets in the UAE. This essentially means that your assets will pass on to all your legal heirs. Your spouse will be entitled to 1/8 of your assets. To avoid this situation, you should clearly nominate the following beneficiaries in your UAE Will:
