Wills in Ras Al Khaimah
The jurisdiction of the DIFC Courts Wills Service (DIFC CWS) has been extended to Wills in Ras Al Khaimah. This has been made effective as of 5 March 2017 through an amendment to the DIFC WPR Rules. Before this amendment, the Wills registered with the DIFC CWS only covered assets situated in the Emirate of Dubai.
The amendment to the DIFC WPR Rules allows non-Muslims to protect their assets in Dubai as well as Ras Al Khaimah through a Will registered with the DIFC Courts Wills Service. The Wills for assets Ras Al Khaimah have thus been given the much awaited legal certainty.
The registration of a Will with the DIFC CWS has the following benefits:
Transfer your assets in Ras Al Khaimah as you wish
DIFC Wills provide certainty on the distribution of assets and the appointment of guardians as per your own wishes. You can thus choose your own beneficiaries for your assets in Dubai and Ras Al Khaimah and appoint the guardians of your minor children (below 21 years of age).
Probate Process is simpler, cheaper and quicker
The probate process under DIFC WPR Rules is simpler, cheaper and quicker than the process that would typically be followed by Dubai or Ras Al Khaimah courts. The main benefits of this process are:
(a) The grant of probate is expected to be issued within an approximate time of 30 days of the date of application.
(b) The executor (typically your wife) can directly make the application for grant of probate at the DIFC CWS offices without the requirement to hire a lawyer. The proceedings at the DIFC Courts are completed in English language and are easy to follow.
(c) There is a fixed fee of only AED 5,500 payable for the grant of probate.
This gives non-Muslims greater trust in the legal system and much needed peace of mind while buying assets and writing Wills in Ras Al Khaimah.
Earlier, the non-Muslim individuals having assets in Ras Al Khaimah typically used to register their wills with the Notary Public (Courts).
For individuals owning assets in Emirates other than Dubai and Ras Al Khaimah, the only available option is to register their Wills with Notary Public (Courts) in their respective Emirates.
