What are the different functions of the DIFC Wills Service Centre and the DIFC Courts?
The article explains the functions of the DIFC Wills Service Centre (the “Wills Service”) and the DIFC Courts in accordance with the Order No. 1 of 2015 In Respect of the DIFC Wills Service Centre Rules (the “DIFC WSC Rules”).
1. Functions the Wills Service
The Wills Service has been set up pursuant to the DIFC WSC Rules.
The function of the Wills Service is the administration of Wills and probate of the non-Muslims having assets in the United Arab Emirates.
The Wills Service refers to the DIFC Court all matters requiring adjudication arising in the administration of the estate and the issue of grants in relation to the DIFC Wills.
The Wills Service works under the management of a Director who is appointed by the Head of the Dispute Resolution Authority at the DIFC.
The Director of the Wills Service has the power to do all things necessary or convenient for the purpose of carrying out the function of the Wills Service and such other powers as may be conferred on him by or under the DIFC WSC Rules or the DIFC law.
2. Functions of DIFC Court
The DIFC issues grants of probate for non-Muslims who have duly registered their Wills with the Wills Service in accordance with the DIFC WSC Rules.
According to the DIFC WSC Rules, all grants, orders and other documents under the DIFC WSC Rules are issued:
- in the name of the DIFC Court;
- under the seal of the DIFC Court; and
- signed by a Judge or a DIFC Court Officer acting with the authority of the Court.
